SHANGHAI, March 26, 2025 /PRNewswire/ -- Newman Infinite, Inc. (translated as Newman Unlimited in Mandarin) announced today that its marquee China patent (CN104115107B) for precision touchscreen technology has once again been upheld following multiple challenges. Newman Infinite successfully defended against two petitions to invalidate its patent, as documented in the May 6, 2024 judicial report from the Chinese Intellectual Property Authority (CNIPA) and China's specialized intellectual property court system. Even so, Microsoft filed a third invalidity petition on February 10, 2025, which the CNIPA subsequently downgraded to an office action review proceeding.
This development follows the conclusion of Newman Infinite's infringement trial in the Shanghai Patent Court against Microsoft, which ended on January 15, 2025. IP courts in both Beijing and Shanghai dismissed appeals and affirmed the patent's validity and enforceability. The parties await the Shanghai court's infringement ruling.
"Microsoft's most recent invalidity petition utilizes evidence that was presented and rejected during the infringement trial before the Shanghai Patent court," said Matthew Allan Newman, CEO of Newman Infinite. "We have numerous corresponding U.S. patents for this same technology that have been granted in recent years by the United States Patent and Trademark Office, as well as internet security patents that we will also bring to their attention."
The judicial ruling and report on the infringement case is expected soon from the Shanghai Patent Court, now that a March deadline for court-supervised mediation has passed, which precedes commencement of damages hearings.
