A new, nationwide study of medical malpractice claims published by The New England Journal of Medicine reveals that a small number of physicians – 1 percent – accounted for the majority of the more than 66,000 paid malpractice claims during a recent 10-year period. A total of 84 percent of doctors had only one paid claim during the same time frame. Says Walsh: "The report reflects what we've known for some time, namely that settling one claim does not mean that a doctor is incompetent or an excessive malpractice risk." More than half the claims in the study were filed against physicians in four specialty groups: internal medicine, obstetrics, general surgery and family medicine. "That focus on primary care practices shows that many patients still seek help from their primary care physician, who is facing decreasing reimbursement rates, increased patient loads and the resulting potential for more problems in patient care."

Politics and Policy Influencing the LGBT Movement

"The reactions of the NBA, PayPal, and others is a small victory for the LGBT rights movement and the transgender movement, but given that North Carolina's new law prohibits local government from adding discrimination protections, the victory is somewhat hollow. And given the addition of new religious freedom laws in states like Mississippi, I don't believe anyone in the LGBT community is celebrating at this moment. This type of law is exactly what SCOTUS struck down in the 1996 Colorado case, Romer v. Evans. The Colorado law was passed at the ballot box in 1992."
Haider-Markel is co-author of "Transgender Rights and Politics: Groups, Issue Framing & Policy Adoption," a book on transgender politics and policy that examines the effects of laws addressing sexual orientation. He has been following the reaction to the North Carolina law that has caused several businesses to abandon plans to do business in the state.

An 'Uber' Solution for Local Trucking

The "Uberization" of American commerce is now rolling into another heavily fragmented sector: the $80 billion-a-year local trucking industry. Convoy, a Seattle start up founded by former Amazon employees, has launched an on-demand service with the goal of giving local truckers -- specializing in jobs that can be completed in a day -- a more efficient way to connect with clients. Says Inge: "The implications for Uber's business model on any delivery-based industry are undeniable, but the impact on commercial transport is uncertain because of the liabilities involved." Matching truckers with clients is typically handled by brokers, who provide both logistical support and a structure to allocate risk for any cargo damaged during transport. "The benefits of an Uber-like system to small companies with intermittent shipping needs are clear, but larger companies may be less inclined to trust valuable cargo to unfamiliar or randomly selected providers."
