On Federal Civil Rights enforcement: "From the Mike Brown case to so many others, we have seen the hesitance of local prosecutors to file charges when unarmed people of color are killed by law enforcement. Federal Civil Rights enforcement, when pursued faithfully, can send a message of accountability. Over 95% of local and elected prosecutors are white -- there is very little diversity in this department. Our amicus brief suggests that no matter the outcome, there should be a civil rights exception that allows the prosecution of violators of civil rights law even if arising out of the same state conduct."
On presidential pardons: "The court should not rule here to create a president's ability to pardon someone from a state criminal offense. I agree with those who say that Trump's power to pardon for 'offenses against the United States' doesn't include an offense against the State of New York, for example.  It would be hard to argue that when the pardon power was created, the intent was to give the president the power to overrule state convictions. This could have a seismic consequence. Of course, Trump could pardon himself and his associates from all crimes. On the progressive dreamer's side, a future president could engage in a mass pardon of hundreds of thousands of nonviolent offenders. It would be an unimaginable expansion of presidential powers that I highly doubt would take place."

Gamble v. US Has Very Little to Do With the Mueller Investigation and the Presidential Pardon Power

On presidential pardons: "This case actually has very little to do with the Mueller investigation and the presidential pardon power. First, New York law already has a statute that limits some state prosecutions based on the same conduct as a prior federal prosecution. Second, if dual sovereignty is abolished, most state prosecutions could go forward if the state charge contained elements not found in the federal charge and vice versa. Mueller is certainly aware of this and many state charges could still be brought even after a federal pardon (e.g., a federal pardon of Manafort would probably present no obstacle for a state tax fraud prosecution of Manafort)."
On dual sovereignty: "If dual sovereignty is abolished, most police misconduct federal prosecutions would be unaffected because the main federal criminal civil rights statute would not be considered the 'same offense' as a state homicide prosecution. But other federal civil rights charges, such as federal hate crimes charges not related to police misconduct, could be affected by the abolishment of dual sovereignty. How the Civil Rights issues shake out will be far more consequential than how this case impacts on the pardon power. Abolishing dual sovereignty will inevitably result in legal uncertainty as other inherently related issues regarding federal civil rights enforcement will have to be addressed in fairly short order."

Former Trump Lawyer Michael Cohen Pleads Guilty to Lying to Congress

Former Trump lawyer Michael Cohen has plead guilty to a federal charge of lying to Congress, admitting that he misled federal lawmakers about a proposed deal to build a Trump Tower project in Moscow, something he was working on in 2015 and 2016 while President Donald Trump was running for the White House. He is expected to be sentenced to between four and five years in prison in December for his first federal case. It's unclear if the new guilty plea will involve more jail time. Cohen has publicly turned against President Trump since the FBI raided his home and offices in April. Says Dellaportas: "Today's plea deal is yet another process crime in which some witness supposedly lied about otherwise legal activity. Like virtually everything else that comes out of the Special Counsel's Office, the true goal appears to be to justify the Counsel's existence, and its limitless, taxpayer-funded budget. If I were Donald Trump's barber or driver or tennis instructor, I would go ahead and hire a lawyer now, because Mr. Mueller will soon be knocking at their door."
