TO:  ALL PERSONS WHO PURCHASED OR OTHERWISE ACQUIRED AMERICA SERVICE GROUP INC. ("AMERICA SERVICE GROUP") PUBLICLY TRADED SECURITIES BETWEEN SEPTEMBER 24, 2003 AND MARCH 16, 2006, INCLUSIVE.

YOU ARE HEREBY NOTIFIED that, pursuant to an Order of the United States District Court for the Middle District of Tennessee, Nashville Division, a hearing will be held on October 15, 2010, at 10:00 a.m., before the Honorable William J. Haynes, Jr., United States District Judge, at the United States District Courthouse, 801 Broadway, Nashville, TN 37203, for the purpose of determining: (1) whether the proposed Settlement of the above-captioned Litigation for the sum of $10,500,000 in cash, plus accrued interest, plus 300,000 shares of America Service Group common stock, should be approved by the Court as fair, reasonable, and adequate; (2) whether, thereafter, this Litigation should be dismissed with prejudice as set forth in the Stipulation of Settlement dated April 28, 2010 (the "Stipulation"); (3) whether the Plan of Allocation is fair, reasonable, and adequate and therefore should be approved; and (4) the reasonableness of the application of Lead Counsel for the payment of attorneys' fees and expenses and the reimbursement of the Lead Plaintiff's expenses incurred in connection with this Litigation.
