BAKERSFIELD, Calif., Aug. 6, 2012 /PRNewswire/ -- Legal-Bay LLC, The Lawsuit Settlement Funding Company, is reporting that the first test trial -- known as a "bellwether trial" in Mass Tort Cases -- was a huge win for the Transvaginal Mesh victim and her husband.  The Plaintiff, Christine Scott, was awarded $5MM by the jury for her pain and suffering of 9 separate revision surgeries.  Her husband was awarded $500K due to their loss of intimacy due to the product defect of the C.R. Bard Avaulta Plus Vaginal Mesh Implant.

Bellwether trials are scheduled to set a "gauge" on the potential value of the thousands of lawsuits.  Another trial is set for April 2013 in NJ, however if the California case is any indication it looks as if the general public believes that these Mesh Manufacturers may be liable for substantial damages.  Legal-Bay previously reported that the value of these cases could be around $100K-$500K depending on damages, but now the California verdict could change things dramatically.  This could cause serious financial exposure for other makers such as: Johnson & Johnson, Ethicon; Boston Scientific; and American Medical Systems, AMS who also face thousands of suits.

Patty Kirby, Head of Client Relations at Legal-Bay commented, "The industry was waiting to see where this first verdict would come in to start to place value on the many vaginal mesh lawsuits in the system, clearly this was a major win for the plaintiffs.  We have already been working overtime trying to assist so many mesh patients with not only getting funding to live, but to assist with getting a cash to assist with paying for their corrective surgery to fix the problems.  I can only expect more victims to start accessing lawsuit settlement funding now that the value of these cases could potentially reach $1MM in some serious cases."
