UK IP Courts Pass Judgment on Onix Trademark Confusion

United Kingdom Intellectual Property Office (UK IPO) has entered formal judgment in favor of Adam Worsfold (Rectification No. 84215 for trade mark number UK00001332605) against Shanling Digital Electronics of Shenzen China, concluding Adam Worsfold's rectification application against Shanling's claimed assignment of the ONIX trademark, and disputing the validity of actions by Mr. Michael O'Brien.
Adam Worsfold is a co-founder of the highly regarded 'Onix' brand of high end audio electronics products manufactured in the UK, which was first established in 1984. Mr. Michael O'Brien, originally of Rogers Loudspeakers, acted independently to re-assign the trademark Onix to others, which was then further reassigned, with the ultimate assignee being Shanling Electronics. Mr Worsfold has long maintained that the trademark was incorrectly and/or illegally assigned.
The UKIPO ruled in favour of Mr. Adam Worsfold after extended action, agreeing that Michael O'Brien acted without authority to do so when he assigned the mark to others. The IPO went further, stating that O'Brien knowingly acted without a formal deed of assignment and re-registered the mark without the consent, or even the knowledge, of the rightful trademark holder, Mr. Adam Worsfold.
After commending the IPO in its commitment to protect rightful trademark holders, Mr. Adam Worsfold announced that he is satisfied with the result, and is looking forward to moving ahead with a planned release of a new line of products under the brand Onix DNA and the associated brand TenTen by Onix.
