
DALLAS, June 23, 2011 /PRNewswire/ -- Today's decision means that the 2001 Texas Probate Court's ruling that E. Pierce Marshall never interfered with his father's estate planning or gift giving before or after J. Howard Marshall, II's death is the final conclusive ruling in the case. The decision will finally put an end to a frivolous lawsuit based on fabricated claims.
In 2001, the Texas jury reached a unanimous decision in favor of E. Pierce Marshall following a 5 1/2 month trial during which Ms. Smith could not provide a single witness to her claims against E. Pierce Marshall. Witnesses did testify that Ms. Smith received close to $7 million from J. Howard Marshall during their relationship and that J. Howard created his own estate plan with the help of his own legal counsel.
The defense of this case is and always has been about J. Howard Marshall II's right to leave his estate to the people and institutions he wanted to benefit from his hard work and vision.
