APPLETON, Wis., June 13, 2014 /PRNewswire/ -- Appvion, Inc. reacted with disappointment to a decision issued by the Department of Commerce (the Department) in the final results in the fourth administrative review of the antidumping order on imports of lightweight thermal paper (LWTP) from Germany.
In the prior administrative review, the Department discovered that German LWTP producer Papierfabrik August Koehler AG (Koehler) had engaged in fraudulent behavior when it reported sales in its home market as third country sales, thereby lowering its dumping margin. As a result of Koehler's fraudulent behavior, the Department imposed duties of 75.36 percent on U.S. imports of Koehler's LWTP.
Despite the fact that Koehler admitted its fraudulent scheme extended into the fourth administrative review period, the Department accepted Koehler's sales as reported because Koehler disclosed the sales were third country sales. Commerce noted in its decision that the fraudulently reported sales accounted for "a significant portion of Koehler's home market sales during this review." As a result, the Department lowered the duty deposit rate for the fourth administrative review period to zero.
"We are very disappointed by the Commerce Department's decision," said Mark Richards, Appvion's chief executive officer. "This is like letting a criminal off the hook just because he admitted his wrongdoing," he added. Richards said Appvion is reviewing the Commerce decision thoroughly and will consider all options, including an appeal.
