Berger & Montague, P.C. Files First Class Action Lawsuit In The Eastern District of Pennsylvania Against Takata, Toyota and Subaru For Defective Airbags That May Explode, Causing Injuries to Vehicle Occupants

PHILADELPHIA, Nov. 7, 2014 /PRNewswire-USNewswire/ -- The law firm of Berger & Montague, P.C. has filed a class action lawsuit suit against airbag manufacturer, Takata Corporation, and automakers Toyota  Motor Sales, U.S.A., Inc. and Subaru of America, Inc., relating to their massive recalls due to dangerous and defective airbag inflators installed in millions of vehicles in the United States.  The suit seeks to represent anyone in the United States who purchased Toyota or Subaru vehicles with a defective airbag. 

The complaint is the first Takata airbag defect class action filed in U.S. District Court for the Eastern District of Pennsylvania, and the first case in the nation naming Subaru as a defendant.  The case is: Raiken v. Takata Corporation, et al., Case No. 2:14-cv-06391-RK.

The complaint alleges that instead of safely inflating to protect vehicle occupants, the defective Takata airbags "turns a life-saving device into one that explodes and sprays metal and plastic shrapnel at vehicle occupants."  The defective airbags have caused numerous injuries and fatalities.  According to the National Highway Transportation Safety Administration ("NHTSA"), at least 7.8 million vehicles now pose an immediate threat to front-seat passengers. NHTSA has urged owners of the affected vehicles to act immediately on recall notices to replace defective Takata airbags.

The faulty airbags have been installed in vehicles made by Toyota, Honda, Mazda, BMW, Nissan, Mitsubishi, Subaru, Chrysler, Ford and General Motors.
