Before Judge Anne-Christine Massulo of the San Francisco Superior Court, attorney Daniel Bornstein conducted a jury trial seeking the removal of the tenant defendant from the premises due to his failure to pay rent. The defendant was represented by attorneys from two separate firms—one private and one public interest.  

The facts of the case were as follows:  The plaintiff (Bornstein's client) entered into a written agreement with the defendant in 2004. The defendant failed to pay rent from January through March in 2013. The defendant claimed that he didn't owe rent due to the conditions of the premises and San Francisco building code violations. The defendant further alleged that the plaintiff was discriminating and retaliating against him due to his disability, and breaching his warranty of habitability. On behalf of the landlord, Daniel Bornstein successfully rebutted the claims raised by the defendant by establishing that they were without merit. After only one hour of deliberation, the jury returned a unanimous verdict in favor of the landlord.

After years of intimidation by the defendant, Bornstein's client finally recovered his San Francisco rent-controlled Unit.
