Code Rebel, LLC Prevails Against Aqua Connect, Inc.'s Trade Secrets Claim in Federal Court
LOS ANGELES, Feb. 15, 2012 /PRNewswire/ --Code Rebel, LLC announced today that a United States District Court Judge granted the motion of Code Rebel, LLC, author of popular remote desktop access software, and dismissed the Trade Secret Misappropriation claim of Aqua Connect, Inc. for a second time.
Last September the same Federal Court dismissed Aqua Connect's claims against Code Rebel for interference with the performance of a contract, misappropriation of trade secrets, and fraudulent transfer, but allowed Aqua Connect to amend those allegations to attempt allege a proper claim.
When Aqua Connect amended its Complaint, it dropped claims for interference with the performance of a contract and fraudulent transfer, but tried to restate its prior allegation of trade secrets misappropriation related to Code Rebel's iRAPP Terminal Server application, which allows users to connect and interact with their Mac via RDP.
In November of 2011, Code Rebel again moved to dismiss Aqua Connect's trade secret misappropriation claim, and earlier this week that motion was granted, this time without giving Aqua Connect leave to amend.
Code Rebel intends to aggressively defend against Aqua Connect's remaining claims, now significantly narrowed, which Code Rebel steadfastly contends are baseless. Further, Code Rebel intends to pursue all of its rights, remedies and recourses through the current lawsuit, once Aqua Connect's claims have been defeated.
