Colorado MED Updates Child Resistance Regulations for Medical Marijuana Centers

Medical marijuana centers must now ensure that all medical marijuana and medical marijuana-infused product is placed within child-resistant containers prior to sale to a consumer. If the container is not child-resistant, the medical marijuana center must place the container within an opaque and resealable exit package that is child-resistant.
The new rules affecting the packaging of marijuana and marijuana-infused products, state the following:
"Child-Resistant means special packaging that is:

Designed or constructed to be significantly difficult for children under five years of age to open and not difficult for normal adults to use properly as defined by 16 C.F.R. 1700.20 (1995) and ASTM classification standard D3475-13. |
b. |
Opaque so that the packaging does not allow the product to be seen without opening the packaging material. |
c. |
Resealable for any product intended for more than a single use or containing multiple servings. |
d. |
Labeled properly as required by the M 1000 series." |
John Kovacevich, Chief Operating Officer of Kush Bottles, states there is a wide assortment of packaging options, but not all have been tested child-resistant in compliance with the standards set by the ASTM and CPSC. "As a medical marijuana center, you have to be careful about the packaging options you utilize," he said. "Some containers may look to be child resistant, but actually have not gone through the testing process because that is time consuming and costly for the manufacturer or distributor," he added. "However, if a medical marijuana center uses packaging that has not been individually tested and certified child resistant, they could face fines, closure, and license revocation.
