Complaints Against BP ARCO Franchisees Dismissed, as Stated by Paul M. Stoddard

PALM DESERT, Calif., Sept. 16, 2013 /PRNewswire/ --  Regarding the complaint, Paul M. Stoddard, Attorney for Defendants states:

On August 21, 2013 United States District Judge O'Neal issued an order dismissing with prejudice and entering judgment in favor of Nachhattar Singh Chandi, Susana Chandi as well as other defendants in the case of Kevin Doan vs. Nirmal Singh et.al., 1:13-cv-00531-LJO-SMS. The dismissal marked the end to three frivolous claims and the termination of a deliberate course of  harassment that commenced on April 4, 2013 with the filing of the first unfounded claim in  Mehroke et al v. Singh et al 2:13-cv-00663-MCE-DAD. This was quickly followed by two equally unfounded claims: Dhaliwal 1:13-cv-00484 on 4/3/2013 and Doan case on 4/13/2013. Although Mr & Mrs Chandi had never met nor had any dealings with any of the plaintiffs in the three actions, the plaintiffs' attorney, Mr. Durst alleged a litany of unfounded civil and criminal claims including RICO violations (Racketeer Influenced and Corrupt Organizations Act). They alleged unfounded claims of defrauding investors through securities in BP ARCO-based operations.  They sent notices of the complaint to BP ARCO officials, financial institutions and publications, both local and international including  Mr. Chandi's birthplace (India).

The first case of Mehroke vs. Singh was dismissed voluntarily through stipulation on April 29. 2013. Motions to dismiss under Federal Rule Civil Procedure 12(b)(6) were immediately  filed in the two remaining cases. The Dhailiwal case was dismissed with prejudice and judgment entered in favor of the Chandis on August 16, 2013. Judge O'Neal dismissing with prejudice all claims against Mr. & Mrs. Chandi as well as other defendants and directing the clerk to enter judgment against Jagjeevan Dhaliwal and Mohinder Gill.

Motions have been filed and are pending to recover in excess of $85,000.00 in attorney fees and costs incurred in terminating the frivolous claims.
