
Complimentary Divorce Seminar: New Jersey's NEW Alimony Law
SHORT HILLS, N.J., Sept. 17, 2014 /PRNewswire/ -- Budd Larner, PC, is offering a free public seminar on Tuesday, September 23rd from 7:00pm - 9:00pm at the offices of Budd Larner, PC, 150 JFK Parkway, Short Hills, NJ to learn how the new changes to New Jersey's alimony laws will affect prospective and/or continuing alimony obligations. For example:
- No longer can the court order "permanent alimony" or "lifetime alimony" which are replaced by "open durational alimony."
- No longer can the court order alimony for a duration longer the length of marriages or civil unions less than twenty (20) years duration, subject to court's consideration of eight "exceptional circumstances," the last of which is any factor "the court deems equitable, relevant and material."
- The court must now consider the nature, amount and length of any interim support paid pending a divorce proceeding.
- A "rebuttable presumption" now exists that alimony should end upon the payor spouse reaching "full retirement age," as determined by the Social Security Act. This presumption applies to existing orders and/or agreements that may or may not address this issue.
- Modification of alimony guidelines established, including where a payor spouse is out of work for at least 90 days, and permits temporary reduction of support pending ultimate determination of any modification, and retroactive relief.
- Alimony may be suspended or terminated if the payee cohabits with another person. Cohabitation involves a mutually supportive, intimate personal relationship in which a couple has undertaken duties and privileges that are commonly associated with marriage or civil union but does not necessarily maintain a single common household.
- Changes do not apply to existing alimony durations or specifically bargained for consideration, but do apply to pending divorce matters.
