Court Grants Preliminary Approval in Class Action Involving YTB International
ST. LOUIS, July 2, 2015 /PRNewswire/ -- Montroy Law Offices and Witzel Kanzler Dimmitt & Kanzler announce a settlement has been reached in a class action lawsuit against YTB International, Inc. (YTB) and certain subsidiaries, individuals, and entities affiliated with YTB on behalf of all independent marketing representatives (IMRs) or referring travel agents (RTAs) who paid fees to YTB on or before January 19, 2009 for an online travel agency (OTA) and maintained the OTA for less than 18 months; have not already received a refund; and didn't receive commissions in excess of the fees paid to YTB.
WHAT IS THIS CASE ABOUT?
The lawsuit alleges that the sales of OTAs marketed through a network of IMRs and RTAs constituted an illegal pyramid sales scheme and chain referral sales technique. Plaintiffs claim the only way individuals could profit was by recruiting others to act as IMRs or RTAs. Defendants deny Plaintiffs' allegations.
WHAT BENEFITS CAN YOU GET?
Class Members may receive an OTA for a Free Access Period, valued at least $549, by submitting an online claim at www.YTBSettlement.com before August 17, 2015, certifying you are an IMR or RTA who paid Defendants to own and operate an OTA on or before January 19, 2009 and that you kept the OTA for less than 18 months and have not already received a refund.
WHAT ARE YOUR OTHER OPTIONS?
You can request to be excluded from the class, object to the settlement, or appear at the hearing.
The Exclusion Form can be obtained at www.YTBSettlement.com. Exclusion requests must be submitted by mail or email by August 17, 2015 as explained in the Class Notice. By excluding yourself you agree to waive your rights or benefits under the settlement but retain the right to sue Defendants based on the legal claims in THIS CASE.
You may object to the settlement in writing by August 3, 2015. Detailed instructions on how to object and where to file your objection can be found on the settlement website at www.YTBSettlement.com.
You may also appear in person or by counsel at the Final Approval Hearing on October 15, 2015 at the U.S District Court - Southern District of Illinois, East St. Louis Division, 750 Old Missouri Ave., East St. Louis, IL, when the Court will consider the fairness, reasonableness, and adequacy of the Settlement and the award of fees and expenses to Class Counsel.
