Dallas Securities Litigation Firm, LewinsLaw, PC, Receives Award for Client Against Hodges Capital Management, Craig Hodges, and First Dallas Securities
DALLAS, July 18, 2018 /PRNewswire/ -- LewinsLaw's securities litigation client was awarded a significant sum by a FINRA Arbitration panel against Craig Hodges, Hodges' brokerage firm, and his investment advisory firm.
The claims stemmed from Hodges' investment advisory investing in aggressive, high-risk oil and gas related stocks and MLPs, that were contrary to the client's stated investment objectives and risk tolerance.
Hodges was paid an advisory fee to manage the investments on an individual basis, taking into account the client's particular objectives and risk tolerances. Instead, Hodges not only over concentrated the client's portfolios in one particular sector, oil & gas, but the investments within that sector were too aggressive. This was a breach of his fiduciary duty as an investment advisor.
"What is significant about this award is that even though the client was a high net worth individual with significant assets and the overall portfolio made money, the arbitrators correctly applied the rules and standards that govern investment advisors," said Richard Lewins of LewinsLaw. "Regardless of whether you're a sophisticated business person or a retired school teacher, the people that advise you on investments have a duty to make sure every recommendation is suitable for you and in your best interest, and if they fail in that duty you have a right to seek redress for their wrongdoing," Lewins added.
