Deepwater Horizon BP Oil Claim Calculator and Allday Consulting Group Prevail In Preliminary Injunction Hearing
FT. LAUDERDALE, Fla., Sept. 23, 2013 /PRNewswire/ -- The Allday Consulting Group, a CPA firm located in Metairie, Louisiana develops and sells the Deepwater Horizon BP Oil Claim Calculator, a software program used by attorneys, accountants and claims processors to compute losses and file claims in the Deepwater Horizon Class Action Settlement. In January 2013, Fort Lauderdale-based IT Strategies Group (ITSG), producers of competing software, filed suit in federal court naming Allday and two of its employees as defendants. ITSG alleged that Allday committed trademark infringement, trade dress violations, unfair business practices, fraud and breach of contract by offering a solution that is in direct competition with ITSG's software.
In an attempt to prevent Allday from selling competing software, ITSG filed a motion seeking a preliminary injunction. On September 9, 2013, the court ruled against ITSG, denying the preliminary injunction. Prior to the ruling, ITSG was warning customers to avoid buying Allday's oil claim software, telling them that the court was going to stop Allday from selling it. Now that the preliminary injunction has been denied, Allday plans to continue to make its Deepwater Horizon BP Oil Claim Calculator available to the public and to further develop and support the software.
ITSG has made other attempts to stop Allday from selling its Deepwater Horizon BP Oil Claim Calculator software. A vice-president of ITSG reported Danny Allday, CPA and president of Allday, to the Louisiana Society of CPAs (LCPA) for ethical misconduct. In light of the fact that Allday has been practicing as a CPA since 1978 and has an impeccable record, and the motion for preliminary injunction was denied, the LCPA has not taken any action on the complaint.
