DeLadurantey Law Office Files Lawsuit Against Florida Credit Repair Firm; Suit Alleges Green Bay Woman Defrauded in Credit Repair Scheme

MILWAUKEE, May 19, 2014 /PRNewswire/ -- DeLadurantey Law Office has filed a lawsuit in the U.S. District Court, Eastern District of Wisconsin on behalf of Green Bay resident Betty Bennett, alleging that she was a victim of a credit repair scheme by the Ft. Lauderdale, Florida law firm of Berges Law Group and its affiliated companies.

In the complaint filed on May 2, 2014, the defendants – Otto Berges; Berges Law Group, P.A.; Consumer Protection Counsel, P.A.; Debt Be Gone LLC; Paralegal Staff Support; and United Legal Group – are charged with violating several provisions of the Credit Repair Organizations Act (CROA) and the Wisconsin Consumer Act.

"Like millions of other Americans who struggle with debt, Betty Bennett has unfortunately been duped by a credit repair scheme that has preyed upon her unfortunate circumstances with empty promises to repair her credit," said Nathan DeLadurantey, managing partner of DeLadurantey Law Office, a Milwaukee consumer protection law firm. "She has paid for services not rendered, and those services have not even been properly communicated to her, in violation of both federal and state law."

The suit states that the defendants contacted Bennett in September of 2013 with an offer to help her fix her credit. She was advised by phone what she would be charged in attorney's fees, which would be paid first, and what she would pay to fix her credit.

A contract was mailed to Bennett on Oct. 30, 2013; however, according to the complaint, the contract did not state a guarantee of performance, did not state an estimate by which the performance will be complete (only the amount of time for which she would pay), did not state an estimate of the length of time necessary to perform the service, did not state the credit repair organizations' principal business address, and did not state the statutory language regarding the consumer's right to cancel the contract. All of these exclusions are in violation of CROA and the Wisconsin Consumer Act.

The May 2 compliant filed by DeLadurantey requests a jury trial seeking actual and punitive damages as well as a declaration that the credit repair contract is null and void.
