Dr Richard Kaul Files Suit in Superior Court in New Jersey Against Drs Robert Heary, Frank Moore, Peter Carmel, Gregory Przybylski, and William Mitchell
NEWARK, N.J., April 2, 2013 /PRNewswire/ -- A six count lawsuit was filed last week in the Superior Court of New Jersey – Bergen County alleging defamation, commercial disparagement, intentional interference with prospective economic advantage, unlawful restraint of competition, conspiracy, and aid in the commission of tort against five doctors. The suit claims that competition in the medical field in the State of New Jersey has led to allegedly damaging the reputation of Dr Kaul, a member of SASI Global, publically demeaning his qualifications, and publicizing disparaging assertions about him and his medical practice.
The suit alleges that their purpose was to suppress the fair-market competition within the medical field, and to reduce the ability of Dr Kaul to practice in the lucrative field of minimally invasive spine surgery. Additionally, the suit asserts that these doctors have conspired to change the CPT codes to ensure that neurosurgeons, like themselves, could monopolize the provision of certain spine procedures throughout New Jersey.
A jury trial has been demanded, and compensatory damages; consequential damages; punitive damages; treble damages; costs, interest and attorneys' fees; and such other relief as the Court deems just and equitable are being sought.
