SACRAMENTO, Calif., Jan. 13, 2017 /PRNewswire/ -- The elderly, stroke-disabled woman who was raped numerous times by a now imprisoned, ex-Sacramento beat cop received a $1.35 million settlement from the City of Sacramento and the apartment complex where the rape took place. At the heart of the civil case has been a dispute over a key legal requirement: whether the officer was on-duty at the time of the attacks. The settlement will be split between the two defendants.
The disgraced former Sacramento Police Officer was sentenced to 62 years to life in prison in November, 2015 after being convicted on nine out of ten counts of rape, forcible oral copulation, assault with intent to commit rape and burglary. The victim "Jane Doe" was in her mid-70's and had suffered a stroke that robbed her of much of her ability to speak. Jane Doe related the attacks to her family members on Thanksgiving of 2010, a year after she'd suffered the stroke.
"This has been a terrible time for our family as we suffered together, both publicly and privately," said family member Rita Doe, who is Ms. Doe's daughter. "With this, it will hopefully bring some closure to my mother who did nothing wrong and was the victim of a horrible crime by a despicable human being."
At the criminal trial, family members testified that Ms. Doe called out "rape," and "police," and pantomimed acts she said she was forced to perform. Various forensics experts and medical professionals testified that physical examinations and crime kit analysis revealed evidence of trauma and bodily fluids. The former office even admitted to performing sex acts with Ms. Doe at the criminal trial.
"I am proud to have represented this deserving and courageous woman. No woman should ever have to experience what she went through," said Eric Ratinoff, attorney for the plaintiff Ms. Doe and her family. "Fortunately, we were able to overcome the obstacles in bringing this case, and we were able to get her the resources she needs."
The City of Sacramento approved the settlement on January 10, 2017.
