Emeco Announces that "East End Imports, N.Y, Inc.," "Sugar Stores, Inc." and All Associated Companies Will Permanently Cease Selling Accused Chairs From Their "Navy," "Sailor," "King," "Ghost," and "Casper" Product Lines

HANOVER, Pa., March 3, 2014 /PRNewswire/ -- Emeco Industries, Inc. today announced that its dispute initiated July 8, 2013 in the Eastern District of NY Federal District Court concerning East End Imports, N.Y. Inc. and Sugar Stores, Inc. has been settled. As part of that settlement East End Imports, Sugar Stores and all associated companies have agreed to permanently cease selling, offering, distributing and marketing "reproductions" from Emeco's Navy Chair and Kong Chair line, the chairs that Emeco accused of infringement. They also agree they will not copy, import, manufacture, induce the manufacture of, distribute, import, advertise, market, promote, offer for sale or sell any chair or article of furniture that is identical to, confusingly or substantially similar to any article of furniture designed, marketed, advertised, promoted, distributed, displayed, offered for sale and sold by Emeco and which is protected by any intellectual property owned by Emeco. Following on the heels of settling The Navy Chair® lawsuit against Restoration Hardware last February, Emeco's suit against the East End Imports and Sugar Stores included claims for trade dress, trademark, and design patent counterfeiting and infringement. According to the Complaint, East End Imports and Sugar Stores do business under several different names, including Modway, Modway Furniture, Lexmod, Atlantic Furniture Store, Mid Century Furniture, Safco Shop, Bestar Furniture Store, and Shop Seating, and other names not yet known or revealed. The individuals named in the suit included Menachem Greisman, Moshe Melamed, and Shneur Hirsch.
