Federal Court Issues Judgment in Favour of Packers Plus in Patent Infringement Lawsuit of Canadian Patent 2,412,072
CALGARY, Jan. 4, 2016 /PRNewswire/ - On December 4, 2015, the Federal Court of Canada issued judgment for Packers Plus Energy Services Inc. in a patent infringement lawsuit filed against Canuck Completions Ltd. in July 2013 for infringement of Packers Plus' Canadian Patent No. 2,412,072 entitled, "Method and Apparatus for Wellbore Fluid Treatment," commonly known to the industry as Open Hole Multistage Ball Drop Fracturing Systems, used in horizontal drilling and completions.
The judgment confirms Packers Plus' exclusive rights under the patent are valid and were infringed by Canuck Completions' IsoFrac multistage hydraulic fracturing systems. The Federal Court awarded Packers Plus $7.7 million in damages and $495,000 for costs of the action, and dismissed Canuck Completions' counterclaim. The Court enjoined Canuck Completions from further infringing the patent or inducing others to do so.
