We act for FilmOn.com, the first internet television provider to launch a high definition service in the United States. Our client, based in the United Kingdom, has business interests and a reputation both in this country and throughout the world.
We have been instructed by our client following the publication in this country inter alia on the Thomson Reuters website (Westlaw News and Insight) of a Statement, stated to have been made by four top U.S. television networks. We are aware that your company is one of the makers of the said Statement, which is as follows :
"It's against the law to steal a broadcast signal and stream it to wireless devices and over the Internet, without the copyright owner's permission. FilmOn.com is the latest in a short line of companies that has robbed our broadcast signals and distributed them illegally for their own commercial gain."
Your company's Statement contains the highly defamatory allegation that our client is guilty of theft and that it carries out robberies. Such an allegation bears the natural and ordinary meaning that our client is in the business of stealing property by means of force or fear. Your Statement goes on to allege that our client then sells on the stolen material illegally. Both allegations impute serious criminal conduct on the part of our client. Neither allegation is capable of justification. As you are very well aware, these allegations are false and no Court in this country, or anywhere in the world, has made any such findings against our client. We have advised our client that your defamatory allegations constitute grave libels of our client.
These libelous allegations, calculated to cause serious harm to our client's business and reputation, continue to be published online. Our client is entitled to hold you liable in respect of the foreseeable republications stemming from your Statement.
The purpose of this letter is to request that you provide, within fourteen days of today's date, the following Undertakings :
- That your company will not repeat the same or any similar allegations concerning our client in the future;
- That you will publish a further Statement, by way of apology to our client, in the form attached;
- That you will pay our client's reasonable legal costs incurred and to be incurred in bringing this matter to your attention and to an amicable resolution;
- That you will pay compensation in a sum to be agreed for the damage calculated to be caused and presumed to flow from publication and foreseeable republications of the defamatory statement.
We await hearing from you as a matter of urgency.
