NEW YORK, June 24, 2025 /PRNewswire/ -- Greenstein & Pittari is intensifying efforts to hold negligent nursing homes accountable as the incidence of bed sores—also known as pressure ulcers—continues to rise in long-term care facilities across the country. These painful and potentially fatal injuries are often the result of inadequate care and preventable neglect.
In one case filed in the Bronx Supreme Court (Index No. 803126/2023E) – the plaintiff, a 72-year-old woman developed several severe pressure ulcers that deteriorated while she resided at a skilled nursing facility. Ultimately, she developed osteomyelitis, and subsequently sepsis.
In another case filed in Kings Supreme Court (Index No. 501877/2024), the plaintiff, a 76-year-old male developed a Stage 3 sacral pressure ulcer at a skilled nursing home, and because of the pressure ulcer's deterioration he contracted Methicillin-resistant Staphylococcus aureus (MRSA), a dangerous and aggressive bacterial infection and he ultimately became septic and died.
In a 3rd case filed in Bronx County Supreme Court (Index No. 814869/2023E), the plaintiff, a 66-year-old woman, developed a sacral pressure ulcer during her admission to a hospital. The ulcer deteriorated to a Stage 4 pressure injury while she was a resident at a skilled nursing facility, ultimately progressing to osteomyelitis, a serious bone infection.
"Pressure ulcers develop when prolonged pressure on bony areas of the body restricts blood flow, leading to skin and tissue breakdown," said Valerie Hernandez, attorney at Greenstein & Pittari and head of the firm's bed sore litigation department. "Without timely intervention, these injuries can result in severe complications such as infections, sepsis, and even death. Tragically, while bed sores are largely preventable, thousands of nursing home and assisted living residents suffer each year due to staff neglect, poor hygiene, and inadequate mobility assistance
Facilities are legally required to assess patients for bed sore risk and to implement care plans that include frequent repositioning, daily skin inspections, pressure-relieving devices, and proper nutrition and hydration. When these protocols are ignored, the results can be devastating. Legal action allows victims and families to recover compensation for pain and suffering, medical expenses, disfigurement, and—tragically—wrongful death.
"Bed sores are a red flag for neglect," said managing partner, Bart Pittari. "No one should suffer because a facility failed to provide the basic care every resident deserves. We're here to ensure families get answers—and justice."
Greenstein & Pittari reports a rise in cases in New York, where families frequently discover ulcers before nursing home staff take action. In many of these instances, standard care protocols were not followed.
The firm urges anyone who suspects neglect to consult an attorney as soon as possible. The legal process typically involves medical record review, expert consultations, and negotiations or litigation. Settlements depend on the severity of the injury, the extent of neglect, and the costs involved in treatment.
With a proven track record of securing substantial settlements in bedsore lawsuits, Greenstein & Pittari offers free, no-obligation consultations to families concerned about a loved one's care.
