PHILADELPHIA, May 8, 2014 /PRNewswire/ -- Hill & Associates P.C. lead by attorney Susan B. Ayres, represented Plaintiff, Abbie Butler for an injury claim as a result of a November 12, 2012 trip and fall accident, against Defendants, Cui Lan Dong, Ben Yi Zhu and the City of Philadelphia (which was voluntarily dismissed prior to trial) in a premises liability claim.

Ms. Butler testified that on the morning of November 12, 2012 she was walking on the sidewalk of the property owned by defendants Dong and Zhu, located at 4236 Cottman Ave. in Northeast Philadelphia when she tripped and fell. Ms. Butler testified that she suffered a dislocation and fracture of her right shoulder.
Ms. Butler testified that immediately after the accident she sought medical care for the shoulder injury in the emergency room. Her shoulder was reduced, placed in a sling and she was put on a home exercise program. Ms. Butler further testified that she continued the home exercise program up through the trial. Ms. Butler also testified that she is right hand dominant and as a result, the injury and subsequent mobility restrictions, caused significant hardship and suffering. These assertions were supported by the testimony of her medical expert, who stated that Ms. Butler had permanent mobility limitations in her right arm as a result of the injury.
The defense asserted that Ms. Butler was comparatively negligent for failing to remain vigilant and watch where she was walking. They questioned the severity of Ms. Butler's shoulder injury, asserting that the injury healed with minimal medical treatment.
The case went to trial in Philadelphia County before the Honorable Rosalyn Robinson. The trial lasted three days. After 45 minutes of deliberation the jury came back with an award of $200,000 for Ms. Butler, finding that defendants, Dong and Zhu were 100% liable for Ms. Butler's injury and that she was entitled to compensation for the pain and suffering she endured as a result of the accident. Ms. Butler was not found to be comparatively at fault for the accident.
