Homeowners Seek Damages from Defective Design and Breach of Warranties

SOUTH ORANGE, N.J., Aug. 8, 2011 /PRNewswire-USNewswire/ -- The Manors at South Mountain HOA, Inc. ("HOA") representing 62 luxury town houses in the New York City suburb of South Orange New Jersey, today filed a lawsuit against one of America's largest home builders Pulte Group, Inc. (NYSE:PHM). The suit, which seeks damages for substantial defects resulting from Pulte's inferior and negligent design and construction, also names Pulte Homes of NJ and other yet to be specified firms and individuals.

"At this point, Pulte has not responded in any meaningful way to resolve the homeowner association's issues and is unwilling to make the necessary, and in some cases critical repairs. As a result, we must pursue legal action," said Michael Miller, president of The Manors at South Mountain Homeowners Association, Inc. "It is unfortunate that given Pulte's reputation and its dominance in the home building and sales industry that it did not exercise responsibility in constructing our community with the high standards and 'unwavering commitment to quality and a disciplined approach to construction' it claims to uphold."

Specific claims in the complaint include a number of unsafe conditions relating to the former quarry. Other claims include, but are not limited to, landscaping issues, safety issues, roof defects, roadway defects, sidewalk defects, grading issues and general construction issues.

Miller stated that the homeowners, contrary to what was promised during the sales process and in Pulte's marketing brochures, have found that Pulte cut corners and engaged in shoddy workmanship in delivering a product designed to appeal to buyers of homes in one of the most competitive high-end real estate markets.

The Manors is located adjacent to the South Mountain Reservation, and was sold by Pulte from 2004 through 2008.
