Intellectual Property Law in Entertainment is Increasingly Complicated; Adli Law is Ready to Simplify the Process for Clients
Legal wrangling over trademarks is as old as pop culture, but you want the most advanced lawyering available for today's globalized world.
LOS ANGELES, June 6, 2013 /PRNewswire/ -- Founded by a noted business and patent attorney, Adli Law Group, P.C. understands that few areas of the law can be as challenging as dealing with trademarks and creative works relating to mass entertainment. Fortunately, the firm has the kind of expertise and the skill – exceptional even for a business attorney in Los Angeles – to properly handle this kind of a case.
An example was pointed out in an article in a recent edition of the Australian online publication, The Conversation. The piece looks at how DC Comics has long been extremely vigilant in protecting arguably its most iconic trademark, Superman, and is becoming even more active with the upcoming release of a new movie featuring the character. Recently, the comic's publisher sued the Australia-based makers of a mixed martial arts instructional video, "Superman Workout." The judge in the Australian court decided against DC on the basis that the term "superman" can be found prior to the creation of the comic's character, as in the works of such authors as Friedrich Nietzsche and George Bernard Shaw. DC Comics, however, continues to maintain that the term "superman" has come to be associated with their character, making them the presumed owner of the term. DC Comics, which is owned by Time Warner, in turn is dealing with a very long running legal and ethical matter involving how it came to own the iconic character originally created by teenagers Jerry Siegel and Joe Shuster in the early 1930s.
These cases are rarely simple– but that doesn't mean it's impossible for the right business attorney to produce desirable results. The entry of China, with its notorious lack of regard for copyright, as a major player on the world economic scene has intimidated some copyright holders, but Adli Law Group P.C. is here to say it should not. It's true that the transnational nature of pop culture has always complicated intellectual property matters – but cases can be won. In the 1960s, Japan's Toho Studios was able to delay the release of the Italian-made classic western, "A Fistful of Dollars" because the film is a blatant remake of an earlier classic samurai film directed and co-written by Akira Kurasawa, "Yojimbo." Today, Kurasawa and his cowriter receive story credit on the film which first turned actor Clint Eastwood and director Sergio Leone into cinematic legends.
Of course, technology has made copyright issues more common and complex. Digital technology makes outright thievery easier, even while some argue that appropriating pop culture figures or creative works can be justified in certain circumstances. Musical and cinematic "mash-ups" combining various works have been a particularly interesting bone of legal contention, and fair use remains a very real legal frontier. The rapidly growing business and art of video games has generated more than its share of legal issues, as well.
At Adli Law Group, P.C., we believe that creators have a right to be compensated for their work when it is used in a commercial context. Just as important, we have the legal experience and the understanding of the ins-and-outs of modern day entertainment to mount persuasive cases that result in successful results for plaintiffs. Considering the strong technical and scientific backgrounds of Dr. Adli and other Adli Law attorneys, this very definitely includes cases covering the most technical issues relating to entertainment copyright law. Importantly, with offices in Taipei, London, and Tokyo, as well as Los Angeles, this is a law firm with truly international reach.
