Judge Renders Final Decision on the PMC Industries, Inc. / RMH Patent Debate
PLAINVILLE, Conn., Dec. 19, 2018 /PRNewswire/ -- PMC Industries, Inc., the manufacturer of the AceClamp® family of products, is disappointed to announce that the United States District Court for the District of Connecticut has found that PMC's Color Snap® product infringes U.S. Patent No. 6,470,629 ("the '629 Patent") owned by RMH, Inc. and Robert Haddock.
While PMC disagrees with the District Court's decision and believes it would prevail on appeal, PMC has decided for business reasons and financial considerations not to appeal the District Court's decision. In compliance with the Court's Order, effective immediately, PMC is removing the Color Snap® product from the market until May 18, 2019, the date RMH's '629 Patent expires.
PMC has consistently maintained that its Color Snap® product does not infringe the '629 Patent. In fact, the United States Patent and Trademark Office found the Color Snap® product to be patentable over the '629 Patent when it granted PMC's application for U.S. Patent No. 9,850,661. PMC also feels somewhat vindicated by the District Court's refusal to find willful infringement.
PMC remains committed to innovation and will continue to work collaboratively with its customers, distributors, and industry partners to improve the technology available in the roofing industry.
