Keystone Dental, Inc. Wins $1.8 Million Judgment Against Dental Implants & Biomaterials S.L.
BURLINGTON, Mass., Dec. 19, 2013 /PRNewswire/ -- Keystone Dental, Inc. ("Keystone" or "the company"), a leading oral healthcare company dedicated to the delivery of breakthrough implant technology, today announced that the U.S. District Court for the District of Minnesota has ordered Dental Implants & Biomaterials ("DI&B") to pay Keystone Dental, Inc. ("Keystone") $1,878,708 for claims related to unpaid invoices and improper use of special discounts.
DI&B had been Keystone's exclusive distributor in Spain from 2008 until 2012, at which time DI&B refused to pay outstanding amounts that it owed Keystone for products purchased by DI&B in 2011. In addition, Keystone believed that DI&B was improperly ordering products using a special discount Keystone had made available to DI&B. After DI&B's CEO, Luis Garralda, rejected Keystone's efforts to resolve these issues through direct negotiation, Keystone sought resolution through arbitration and, eventually, litigation in the U.S. District Court of Minnesota. Then, after the preliminary issues of jurisdiction had been decided by the Court and the parties had engaged in the discovery process for approximately six months, DI&B's U.S. legal counsel abruptly withdrew from the case and DI&B, through its Spanish legal counsel, renounced the jurisdiction of the U.S. District Court of Minnesota.
After DI&B refused to retain substitute legal counsel and, according to U.S. Chief Magistrate Judge Arthur J. Boylan, "willfully violated" the Court's discovery order, the Court issued a judgment in favor of Keystone, characterized DI&B's behavior as "vexatious" and concluded that "DI&B requested discovery from Keystone for the improper purposes of harassing, causing unnecessary delay, and needlessly increasing the cost of litigation" and that "DI&B's discovery conduct was without substantial justification and that sanctions against DI&B are warranted".
