Kush Bottles Urges Dispensary Owners to Check the Facts on Child Proof Packaging
Colorado Marijuana Enforcement Division has issued a new bulletin with a stern warning to dispensaries
SANTA ANA, Calif., Jan. 27, 2014 /PRNewswire/ -- Kush Bottles, North America's largest wholesale distributor of child-resistant packaging for the marijuana industry, commented today on the new bulletin sent to all Colorado marijuana dispensary owners from the Marijuana Enforcement Division of the Colorado Department of Revenue.
The bulletin states, "All Retail Marijuana Stores and Medical Marijuana Centers must be in compliance with the packaging rules without exception."
The bulletin also emphatically specified, "All Retail Marijuana, Retail Marijuana Concentrate, Retail Marijuana Product, Medical Marijuana and Medical Marijuana Concentrate must be sold in Child-Resistant packaging."
While regulations require that marijuana be packaged in approved child-resistant containers, many dispensary owners are finding out that some bottles that distributors claim are child-resistant, have not passed state-approved testing as established by the ASTM (American Society for Testing and Materials), nor do they meet the requirements of child-safe containers as set forth by the Consumer Product Safety Commission (CPSC), nor do they use FDA-approved materials.
"Unfortunately, the market has been flooded with cheap bottles made in China with inferior materials, that have not been tested to meet ASTM and CPSC standards," said Nicholas Kovacevich, COO of Kush Bottles. "It is incumbent upon the dispensary owner to know whether or not their packaging meets government standards," he added. "The penalties for using unapproved packaging are quite severe."
The bulletin to dispensary owners concluded with a stern warning: "To be clear, a violation of the packaging rules shall be considered a violation affecting public safety and can result in severe sanctions against your license."
Kush Bottles is one of the only distributors that has had their bottles tested by an accredited third party testing lab, using standards set forth by the ASTM. The testing facility is one of the most renowned in the United States and has been conducting tests under contract with the Consumer Product Safety Commission for over 35 years.
In summary, Kush Bottles Phillips Rx pop-top bottles (13, 19, 30, and 60 Drams) have been tested and are approved for Child Resistance. Testing is in compliance with ASTM standards. These bottles meet the requirements for child resistant packaging in Colorado, as well as in Washington and every other state with medical or recreational marijuana.
