Nationally Renowned Divorce Attorney Jeffrey Fisher Discusses The "CEO Divorce" With The New York Times
WEST PALM BEACH, Fla., Feb. 14, 2015 /PRNewswire/ -- Jeffrey D. Fisher of Fisher & Bendeck, P.L., www.fisherbendeck.com, was quoted in the New York Times on Sunday, February 8, 2015 in an article entitled "Are C.E.O.s That Talented, or Just Lucky?" authored by Robert Frank. http://www.nytimes.com/2015/02/08/business/are-ceos-that-talented-or-just-lucky.html?_r=0
The comprehensive article focused on the ruling in billionaire Harold Hamm's divorce and addressed one of the biggest issues in high net worth divorces for CEOs and other executives—whether the value of their businesses is driven by "active" or "passive" appreciation. The distinction between the two can make a difference of tens of millions of dollars in high stakes divorces. Mr. Fisher tried to verdict one of the leading cases in the country where the issue was put in dispute by Chicago's Yellow Cab magnate David Markin. Markin attempted to claim, as described by the judge, that he was "merely a passenger on this corporate ship traveling through the ocean," and that his marital efforts were not responsible for the enormous increase in value of the company during his marriage. The court rejected that argument, finding that all of the increase in the value of the business during the marriage was marital, and that ruling was affirmed by the Florida appellate courts.
Mr. Fisher recently published an article on the "Tax Consequences Of Distributing Equity Compensation Rights In Divorce" in the prestigious Florida Bar Journal. The complex mechanics and tax consequences of distributing restricted stock, vested and unvested stock options, and other forms of equity compensation is interrelated to the issue of active and passive appreciation. Mr. Fisher is regularly consulted by Fortune 500 executives, athletes, and celebrities with respect to their divorces because expertise in these legal doctrines are increasingly important in high net worth divorce cases.
Mr. Fisher holds a J.D. from the University of Miami School of Law and is a former Assistant U.S. Attorney for the Southern District of Florida. Worth Magazine identified him as one of the "Top 10 Divorce Lawyers in the Country"--characterizing him as a "Pit Bull Former Prosecutor."
