NUBY® Files Trade Dress Infringement And Unfair Competition Action Against Cudlie Accessories, LLC

MONROE, La., May 15, 2013 /PRNewswire/ -- Luv n' care, Ltd. – maker of the famous NUBY® brand infant products – has announced that it has sued Cudlie Accessories, LLC in the District Court for the Southern District of New York for infringement of its trade dress associated with the designs of its soft top, flip top and straw top cups.  Luv n' care intends to amend its complaint shortly to include a trade dress infringement cause of action related to the design of its hard top cups.  Luv n' care's complaint also accuses Cudlie of unfair competition due its marketing of confusingly similar no-spill cup designs to those of Luv n' care.

This lawsuit follows a string of successful legal victories protecting NUBY's rights in its innovations, including suits against:  Jackel International, Walgreens, Atico, Royal King of Thailand, Kmart, Sassy, The First Years, Philips GmbH (parent company of Philips AVENT), Baby King, Novatex, and others.  Luv n' care has also filed further lawsuits against Munchkin, Toys R' Us/Babies R' Us, and others for copying its no-spill cups, and violating the intellectual property rights therein.  Moreover, Luv n' care is in the process of preparing and filing additional lawsuits against retailers and manufacturers who willfully continue to carry or copy its protected intellectual property products.
