
Popular Sleep Supplement Brand Settles Patent Infringement Suit Against Store Brand Manufacturer
Dispute Between Patented MidNite® Sleep Aid and Contract Pharmacal (CPC) Settled; CPC Can No Longer Manufacture Or Sell Store Brand
BLAUVELT, N.Y., Oct. 19, 2011 /PRNewswire/ -- The maker of MidNite® Sleep Remedy, a patented, natural sleep aid with a proprietary formula, has succeeded in protecting the brand against patent infringement by a store-brand manufacturer, according to the company president, Holly Rosenthal. Under the terms of the agreement reached between Concepts In Health, Inc., maker of MidNite Sleep Remedy, and Contract Pharmacal (CPC), a contract manufacturer who was manufacturing CVS Natural Sleep Aid, a private label version of the patented MidNite product, CPC agreed to discontinue manufacturing and selling CVS Natural Sleep Aid or any substantially similar product. Additionally, CPC will not challenge the validity or enforceability of the MidNite patent (US Patent 6,703,412).
