Potts Law Med Mal Verdict Leads to Suit Against Kansas State Insurance Fund for Bad Faith
KANSAS CITY, Mo., Feb. 7, 2011 /PRNewswire/ -- On March 13 2009, Derek Potts and Tim Sifers of the Potts Law Firm, LLP obtained the landmark medical malpractice verdict of $12.1 million in the United States District Court of Kansas on behalf of eight year old Margaret Millard against her emergency room physician Dr. Lisa Gard arising out of Dr. Gard's failure to diagnose a life threatening spinal cord condition. On January 24, 2011, Dr. Gard filed suit in the District Court of Wyandotte County, Kansas against the Kansas Healthcare Stabilization Fund for breach of fiduciary duty, bad faith, negligence and failing to properly settle her claim. The suit seeks civil damages for $11,250,000 representing the amount of the verdict and judgment for which Dr. Gard is personally liable over the Fund's coverage. When asked about the filing, Derek Potts stated: "My clients and I are very pleased to hear that Dr. Gard is pursuing this claim so that hopefully in the future doctors will be properly protected and their cases appropriately settled by the Kansas Healthcare Stabilization Fund when reasonable settlement offers within the insurance policy limits are made by the plaintiff."
