Preliminary Approval Granted In Lawsuit Involving Purchasers of Truong Giang Corp. Products
LOS ANGELES, April 27, 2015 /PRNewswire/ -- The Los Angeles County Superior Court has granted preliminary approval to a proposed settlement in a class action lawsuit involving purchasers of certain Truong Giang Corp. ("TGC") products. The case is Perry v. Truong Giang Corp., No. BC539568, and alleges that Defendant TGC made false and misleading claims, and breached express and implied warranties regarding its products.
Who is Included in the Settlement?
Class Members are all U.S. consumers who purchased the Defendant's Products listed below for household or personal use between March 17, 2010 and March 30, 2015. The products included are:
- 3 Ballerina Tea Dieter's Drink Extra Strength
- 3 or Three Queen's Ladies Tea (Regular and Extra Strength)
- Herbal Tea (including Ginseng Flavor, Lemon Flavor, Cinnamon Flavor, and Orange Flavor – Regular and Extra Strength)
- Two Ladies Dancing with Tree Tea (Regular and Extra Strength)
- Double Sailing Ship Tea
- Special Tea
- Three Star Brand Special Tea
- Two Beauties (Three Stars) Herbal Tea
- American Ginseng Tea
- Tu Chung Tea
- 3 Ballerina Herbal Slim Capsules
What are the Terms of the Settlement?
The Defendant has agreed to certain modifications of the labeling and packaging for its products. These modifications include removing certain language and adding a disclaimer notifying consumers that the statements on the products have not been evaluated by the Food and Drug Administration.
