On Kennedy's replacement and confirmation process, Geyh explains: "Justice Kennedy was a critical moderate voice and swing vote on the Court. His replacement is of critical importance to the ideological balance on the Court, and is sure to generate a firestorm. The appointment process has always been 'political,' but has ramped up in recent decades to the point where long respected devices aimed at promoting deliberation, consensus, and compromise have been scrapped in favor of bare knuckle politics. The net effect is that between now and the mid-term elections, Senate Democrats are unlikely to have any meaningful influence. I would be surprised if the president sees fit to seek their 'advice' (as the Constitution provides) before the nomination. Without a filibuster they cannot block a nomination by themselves; and in times this polarized, I do not see many – if any – Republicans crossing party lines and voting with the Democrats against a Trump nominee. The Democrats can, however, be expected to label the next nominee an ideological extremist (just as the GOP did with Obama nominees), which has had a demonstrable and adverse impact on the public's perception of the Court's legitimacy."

Rolling Back Obama-Era Policies on Race in College Admissions

On the Trump Administration's plans to roll back Obama-era policies on race in college admissions, Brown explains, "I would not describe the guidance they are revoking as expanding affirmative-action beyond what the Supreme Court said. So, my initial thoughts are that this is primarily about the Trump Administration sending a message that they will be more aggressive in attacking admissions programs that use race in admissions and will consider instituting legal action to overturn the Court's affirmative action jurisprudence." Brown adds, "This is all also likely to have a further chilling effect on the use of race in admissions. It will provide additional justification for college administrators who are not committed to using race to argue that less emphasis should be placed on race in admissions."
