NEW YORK, April 3, 2017 /PRNewswire/ -- The talcum powder litigation underway in Missouri's 22nd Circuit Court in St. Louis is scheduled to convene two additional ovarian cancer trials in the coming months. According to court documents, the consolidated proceeding's fifth trial is to begin on April 10th, while the sixth trial will commence in June. Both lawsuits were filed on behalf of women who allegedly developed ovarian cancer due to the long-term use of Johnson & Johnson's talc-based powders for feminine hygiene purposes. Johnson & Johnson and other defendants had sought to stay both trials; however, those motions were denied by the Court on March 15th. (Case No 1422-CC09012-01)
"We look forward to jury decisions in these two cases. Our Firm has heard from numerous women who are alleged to have developed ovarian cancer due to their talcum powder use. Verdicts in these trials could provide insight into possible jury decisions in similar talcum powder lawsuits," says Sandy A. Liebhard, a partner at Bernstein Liebhard LLP, a nationwide law firm representing victims of defective medical devices, drugs and consumer products. The Firm is offering free legal reviews to women who were diagnosed with ovarian cancer that may be associated with long-term use of Johnson & Johnson's Baby Powder and Shower-to-Shower talc-based powders.
Talcum Powder Litigation
More than 3,000 talcum powder lawsuits that put forth similar ovarian cancer allegations have been filed against Johnson & Johnson in state and federal courts around the country. Around 1,000 of these cases have been consolidated in Missouri's 22nd Circuit Court. Thousands of similar complaints are pending in state courts in New Jersey, Delaware and California. Federally-filed talcum powder lawsuits have also been consolidated in a multidistrict litigation that is currently underway in the U.S. District Court, District of New Jersey. Four talcum powder trials have been convened in Missouri over the past year. Johnson & Johnson has prevailed in only one. Claimants in three other trials were awarded compensatory and punitive damages amounting to $70 million, $72 million and $55 million.
Plaintiffs who have filed talcum powder lawsuits against Johnson & Johnson claim that the regular and repeated genital application of Baby Powder and Shower-to-Shower talc-based powders increases a woman's risk for cancer. They further allege that the company has long been aware of research dating back to the 1970s that suggests an association between genital talc use and ovarian cancer, and claim that Johnson & Johnson placed profits over consumer safety by failing to provide the public with appropriate safety warnings.
Women who were diagnosed with ovarian cancer following the long-term use of talc-based products for feminine hygiene purposes may be eligible to file their own talcum powder lawsuit.
