NEW YORK, July 24, 2017 /PRNewswire/ -- Philip R. Shawe awarded more than $100,000 to the law students who developed the best mock Supreme Court arguments overturning Delaware Chancellor Andre Bouchard. His decision to force the sale of the privately held, successful company, TransPerfect, against the wishes of multiple shareholders in opposition to the Fifth and Fourteenth Amendments to the U.S. Constitution was the first of its kind in the United States. Property Rights Advocate Suzette Kelo was an honored guest for the evening's events.
During his keynote address: Professor Alan Dershowitz, one of the competition judges and an attorney on case, foreshadowed that the TransPerfect case was the beginning of the end for the State of Delaware as the incorporation capital of the U.S. by calling the term "Delaware Justice" "an oxymoron, because it simply does not exist." He also referred to Chief Justice Leo Strine, Chancellor Bouchard's former law partner, who affirmed his unprecedented decision against the backdrop of a powerful dissent by Justice Valihura, a "Judicial Tyrant."

The moot court presentation featured a distinguished panel of judges, who honored the Top-10 competitors, and heard oral defenses by the top three student teams. Professor Dershowitz, Judge Carmen Beauchamp Ciparick (Ret), Senior Associate Judge of the New York State Court of Appeals, Justice Melvin Schweitzer (Ret), New York State Supreme Court, Commercial Division, and Joseph D. Hansen, former Director of Interns for Justice Schweitzer, New York State Supreme Court, Commercial Division served as the Supreme Court Justices for the competitors.
The winners were as follows:
- First Place - Steven Hermosa of the University of Florida Levin College of Law recent graduate - $65,000
- Second Place (tie) - Alison Tilden and McKaye Neumeister of Yale law School - $25,000
- Second Place (tie) - Catherine Dowie of Suffolk University Law School - $25,000
At the Charity Gala celebration held at the new 1 Hotel Brooklyn Bridge following the moot court presentations, Shawe kicked off a donation drive for four philanthropies by personally donating $50K to the V Foundation for Cancer Research. The other organizations supported were: Resilience Rising, Ali Forney, and the Key West Film Festival.
Ending the Litigation
At the Gala, Shawe made a public offer to his co-CEO Liz Elting, with whom he has been battling to stop the sale of the company. The offer is simple: Elting can name her price for TransPerfect, any price she wants, and Shawe will have the option to buy or sell at the price Elting sets, no conditions. It is an offer that Professor Alan Dershowitz, one of the judges of the competition and an attorney for Shirley Shawe in the case, said was "so reasonable, and such a defensible position," that it represented the "Paradigm of Justice."
New York Giant Jason Pierre-Paul was the Honorary Bailiff presiding over the award ceremony, and greeted guests at the Gala, while Snoop Dogg made a surprise appearance and entertained the audience until close.
"The mock-Supreme Court arguments, and the Charity Gala were a success beyond all expectations, and we are now considering making this a recurring event," Philip Shawe said. One suggestion under consideration for next year's law school competition is to compare, contrast and analyze Chancellor Andre Bouchard's highly unusual privilege rulings.
