Trial Lawyers Thomas R. Kline, and Robert J. Mongeluzzi Endorse PA Attorney General's Prosecution Of Engineer in May 12, 2015 Fatal Amtrak Derailment
PHILADELPHIA, May 12, 2017 /PRNewswire-USNewswire/ -- Trial attorneys Thomas R. Kline, and Robert J. Mongeluzzi this evening, following the announcement by state Attorney General Josh Shapiro, endorsed his filing of several criminal charges against Amtrak Engineer Brandon Bostian, whose reckless and grossly negligent conduct caused the May 12, 2015 fatal Amtrak Train No. 188 derailment. Eight passengers died and more than 200 were injured in that preventable catastrophe.
Attorney Kline and Mongeluzzi noted that Shapiro's office charged Bostian with the same crimes that the Philadelphia District Attorney declined to prosecute. The Attorney General's office became involved after a Philadelphia Municipal Court judge reversed a decision by the DA's denying a private criminal complaint against Bostian filed by the father and husband of Rachel Jacobs, one of the eight passengers killed in the derailment. Citing a conflict, the DA referred the case and charging decision to the Attorney General.
Mr. Kline and Mr. Mongeluzzi, on behalf of the Jacobs family and all victims of the derailment, could not be more pleased.
"All Pennsylvanians should be grateful that there is an Attorney General willing to do what is right and just to hold Engineer Bostian accountable for his reckless conduct," said Mr. Kline.
"The charges he faces are serious, warranted, and deserve to be heard by a jury."
Mr. Mongeluzzi added, "The Attorney General's bold, decisive action sends a loud and clear message that endangering the lives of rail passengers, crews and the public will not be tolerated in Pennsylvania, and should not be tolerated anywhere," said Mr. Mongeluzzi.
