NEW YORK, Oct. 28, 2016 /PRNewswire-USNewswire/ -- A California woman has been awarded more than $70 million, after the Missouri jury hearing her talcum powder lawsuit (http://www.rxinjuryhelp.com/talcum-powder/johnson-johnson-baby-powder-lawsuit/) found that Johnson & Johnson and its talc supplier, Imerys Talc America, were negligent for failing to warn consumers of the potential link between talc and ovarian cancer. The October 27th verdict marks the third consecutive time this year that a jury has awarded substantial damages in a case involving Johnson & Johnson's talc-based powders and the potentially deadly disease. Talcum Powder Litigation
This most recent talcum powder trial was the third case to go before a jury in Missouri's 22nd Circuit Court in St. Louis, where hundreds of similar cases have been centralized. According to her lawsuit, the 62-year-old Plaintiff was diagnosed with ovarian cancer in 2012. Prior to that, Johnson & Johnson's Baby Powder had been a regular part of her daily feminine hygiene routine for years. During the trial, her attorneys cited more than 20 medical journal articles published since the 1970s that have suggested talcum powder could contribute to the development of ovarian cancer. Jurors were also shown internal documents indicating that Johnson & Johnson was aware of those studies for decades, yet chose not to include a warning label on its talc products.
Yesterday's verdict followed just three hours of deliberations. Johnson & Johnson was assessed $65 million in punitive damages, as well as 90% of roughly $2.5 million in compensatory damages. Jurors also levied $2.5 million in punitive damages against Imerys, along with the remaining compensatory damages. This was the first time Imerys was found liable in a talcum powder case involving ovarian cancer.
Johnson & Johnson currently faces more 1,800 talcum powder lawsuits in courts around the country. In February, another St. Louis jury awarded $72 million in compensatory and punitive damages to the family of a woman who died from ovarian cancer following three decades of genital talc use. That verdict was followed by another plaintiff's victory in May, at which time $55 million was awarded to a woman who was diagnosed with ovarian and endometrial cancer in 2011, after having used Johnson & Johnson's products for nearly 40 years.
