Montway Wins Uniform Domain - Name Dispute Resolution Policy (UDRP) Lawsuit

CHICAGO, Aug. 22, 2012 /PRNewswire/ -- A decision in the recent lawsuit, Montway, Inc. d/b/a Montway Auto Transport v Triton Logic, LLC c/o Auto Transporters Direct, FA1206001448066, awarded the status "Transferred" in favor of Montway Auto Transport.

Internet Corporation for Assigned Names and Numbers is the umbrella organization that UDRP falls under. ICANN coordinates unique identifiers that make navigating the internet's vast array of websites easy for public use and purveyors.  URDP is the deciding panel for when a dispute arises. The organization made the decision after hearing the dispute between Montway and Auto Transporters Direct.

The dispute was regarding usage of the domain name, monwayautotransport.com by Auto Transporters Direct whereby the company used Montway's site name to garner business for themselves. The case – heard by Uniform Domain-Name Dispute-Resolution Policy (UDRP) or ICANN – found that Auto Transporters Direct was, in effect, stealing Montway's name to boost their business.

The company illegally used the former website of Montway Auto Transport in an effort to boost sales by latching onto clients who visited the site in search of car shipping services delivered by Montway. They failed to tell clients that they, in fact, did not reach the company that they intended – instead, Auto Transporters Direct took the clients that were meant for Montway. In doing so, they deceive customers about the car delivery cost and the service they would receive.

Montway earned the rights to trademark in May. James A. Carmody, Esq., a panelist for UDRP, signed off on the order that transferred the domain name from the respondents, to Montway on July 21. Thus, when consumers need to ship a car now, they can be confident the service will be provided by Montway.

Montway Auto Transport CEO, Mike Mihailov said, "We offer exemplary services and to have someone using our name and scamming our customers is intolerable.
