Howard Srebnick, From The Firm Of Black, Srebnick, Kornspan And Stumpf, Comments On His Key Victory in The United States Supreme Court In Sila Luis V. United States
MIAMI, April 1, 2016 /PRNewswire/ -- Yesterday, the U.S. Supreme Court issued an opinion that will shape the future of the private practice of criminal defense. In a case that threatened the demise of the private bar, the Court ruled that a pretrial injunction prohibiting a criminal defendant from spending untainted assets to retain counsel of choice violates the Sixth Amendment.
Yesterday's 5-3 decision in Sila Luis v. United States, was immediately hailed as a victory by the legal community, with coverage in the National Law Journal, Law 360, the Daily Business Review, as well as other national publications such as the LA Times and the Wall Street Journal. Black, Srebnick, Kornspan & Stumpf is proud to recognize the dedication of Howard Srebnick and Josh Shore of the Firm, along with co-counsel Scott Srebnick, in pursuing the case for over three years. "This is a significant ruling for both citizens accused of a crime and for the criminal defense bar," said Howard Srebnick.
"For a citizen accused, it assures her of the ability to use her lawfully possessed assets to retain counsel of choice in order to defend against the government's efforts to incarcerate and impoverish her," Srebnick said. "For the defense bar, it means that we will continue to have the resources available to do our jobs to the best of our abilities."
