Angeion Group's Steven Weisbrot to Address the Latest Frontier in Class Action Litigation, Ascertainability
PHILADELPHIA, Sept. 16, 2014 /PRNewswire/ -- Angeion Group's Steven Weisbrot, Esq., a nationally-recognized class action expert, will be a featured speaker on the rapidly evolving issue of ascertainability in class action litigation at two pivotal upcoming legal industry conferences. Ascertainability has been described as "an essential prerequisite" to class certification and the multitude of courts which have been engaging in an ascertainability analysis has caused many in the industry to question the continued viability of certain class action claims, namely those involving over-the-counter consumer products such as cosmetics and food products. As the class action bar continues to address evolving challenges pertaining to the ascertainability requirement for class certification, Weisbrot will share his insights and suggestions on this central topic.
Weisbrot has the distinction of being the only expert in the country to have multiple federal courts consider his testimony in determining whether to certify consumer class actions. This Wednesday, September 17, 2014 from 2:00 – 3:30 pm EDT, Weisbrot will be part of a trio of industry experts speaking at a Perrin Conference webinar entitled "Ascertainability and Damages Issues in Food and Cosmetic Mislabeling Class Actions."
Next month Weisbrot will participate on a panel on ascertainability at the 18th Annual National Institute on Class Actions in Chicago, IL, sponsored by the American Bar Association. Weisbrot will join other notable authorities on ascertainability speaking on a panel titled: "Big Shoulders and High Standards" Can Plaintiffs Scale the Third Circuit's New Ascertainability Wall? The panelists will discuss and debate the decision by the United States Court of Appeals in Carrera v. Bayer Corp., where the Third Circuit vacated class certification because the plaintiffs hadn't met their burden of proving that class members were ascertainable. The hour-long program will be moderated by Melissa H. Maxman of Cozen O'Connor and will take place on Friday, October 24, 2014 from 2:30-3:30 pm.
According to Weisbrot, "Ascertainability is the next frontier in consumer class action litigation" and he predicts that ascertainability will be "the front-line in the ongoing battle between consumers claiming that a company engaged in wrongdoing, and a company's due process right to defend itself."
