Barnow and Associates, P.C. announces settlement with Calumet Transload Railroad, LLC
CHICAGO, May 25, 2016 /PRNewswire/ -- If you owned property located within the boundaries of Torrence Avenue on the West, 95th Street on the North, the Illinois-Indiana border on the East, and 114th Street on the South, at any time from October 31, 2008 to and including March 1, 2016, you may be entitled to a cash payment from two class action settlements.
Settlements have been reached with KCBX Terminals Company, Koch Carbon, LLC, and DTE Chicago Fuels Terminal LLC ("First Settlement Defendants") and with Calumet Transload Railroad, LLC, George J. Beemsterboer, Inc., and Beemsterboer Slag and Ballast Corporation ("Second Settlement Defendants") in a class action lawsuit about whether they failed to take reasonable and adequate measures to prevent petroleum coke ("petcoke") and coal dust from contaminating nearby areas. Petcoke is the product of oil refinery coker units or other cracking processes. It is a black-colored carbon-based solid that may contain sulfur as well as traces of metals and other non-volatile compounds. Defendants deny all liability.
First Settlement Defendants have agreed to pay a total of $950,000 into a Settlement Fund. Second Settlement Defendants have agreed to pay a total of $505,000 into a Settlement Fund. After deducting the costs of settlement notice, claims administration, and Court-approved attorneys' fees, costs, and expenses, and Representative Plaintiff service awards, the net Settlement Funds will be divided equally among all Settlement Class Members who submit a valid Claim Form. Claim Forms must be submitted online or mailed by September 24, 2016. You only need to file one Claim Form to receive a payment from both Settlements.
The U.S. District Court for the Northern District of Illinois, located at 219 South Dearborn Street, Chicago, Illinois 60604, will hold a hearing in this case (Campos v. Calumet Transload Railroad, LLC, No. 1:13-cv-08376) on July 26, 2016, at 11:00 a.m. At the Fairness Hearing the Court will decide whether to approve: (1) the Settlements; and (2) Class Counsel's request for $316,666 in attorneys' fees from the First Settlement and $168,334 from the Second Settlement (1/3 of each Settlement Fund), reimbursement of costs and expenses, and service awards of $5,000 from the First Settlement and $2,500 from the Second Settlement to each of Representative Plaintiffs. You may appear at the hearing, but you do not have to. You also may hire your own attorney, at your own expense, to appear or speak for you at the hearing.
