Blogger Responds To Jody Kriss Notice To Sue
-Cites 1st Amendment Rights In Saying Kriss Is A Serial Plaintiff-
NEW YORK, April 9, 2014 /PRNewswire/ -- Today, in New York State Supreme Court, Jill Levi of Todd & Levi, LLP filed a notice in response to Jody Kriss of East River Partners notice against Blogger Adam Lombardi.
As Levi cites in her document: "Without prejudice to Mr. Lombardi's right to fully respond to any complaint served by Plaintiff in this action, Mr. Lombardi, an investigative political journalist and blogger, notes that the very commencement of this action is a blatant attempt to eradicate one of the hallmarks and most cherished values of a free society: the first amendment and free speech. In a desperate attempt to muzzle not only Mr. Lombardi, but also anyone else who may wish to expose the truth about Plaintiff, Plaintiff has threatened Mr. Lombardi with a twenty million dollar judgment. This is nothing other than a scare tactic designed to cover up, among other things, Plaintiff's 'dealings' with his 'Mafia pals,' as reported in the New York Post on March 16, 2014."
As she continues, "Regrettably, this lawsuit is yet another in a long line of frivolous and meritless litigations commenced by Plaintiff in the state and federal courts in which Plaintiff seeks to browbeat defendants into silence and submission. Indeed, this 'serial plaintiff' has included frivolous claims in his $1 Billion lawsuit against a long list of prestigious law firms, such as Nixon Peabody and Morgan Lewis. Plaintiff appears to believe he can conduct himself like he is in Putin's Russia, where mob-like and terrorist tactics are routine and effective, but the right of free speech is alive and well in this country and Mr. Lombardi will not give in to this threat to his fundamental liberties."
As has previously been reported, in a complaint filed a few weeks ago, a plaintiff alleged that Kriss "uses his veneer of power and prestige, and the court system, to repeatedly sue and extort innocent defendants...He has attempted to extort all of these various parties by filing no less than four frivolous, sensational lawsuits over the last five years." March 21, 2014 marks the most recent lawsuit of Kriss' which has been dismissed.
