Centre Law Wins Important Protest on Non-Manufacturer Rule
VIENNA, Va., Jan. 18, 2013 /PRNewswire/ -- On January 14, 2013, Centre Law Group won yet another size protest on the Small Business Administration's (SBA) non-manufacturer rule. Centre's victory empowers small business resellers to compete for and receive small business set aside contracts. Centre's client, Alvarez & Associates LLC (Alvarez), is a Service-Disabled Veteran-Owned Small Business (SDVOSB) who was the awardee of a U.S. Army contract for the installation and maintenance of multifunctional office equipment. An unsuccessful offeror filed a protest arguing that Alvarez was ineligible for the award on the grounds that Alvarez was allegedly a "pass through" in the supply chain. Centre was able to prove that Alvarez manages and takes responsibility for all products delivered during the course of sale. "Centre's victory in this case is a testament to Alvarez's successful history as an IT solutions provider for the Government. It demonstrates that small businesses can stand up and be counted," said Alvarez's attorney, Stephen Ramaley of Centre Law Group.
This case builds on a previous Centre victory involving the SBA's non-manufacturer rule, which set a national precedent benefiting more than 1 million small business resellers. The prior case, Size of Appeal of Wear-Mark, Inc., SBA No. SIZ-5397, 5402 (2012), held that resellers who take legal title to their products during the course of a sale, though not physical possession, still satisfy the SBA's requirement that resellers be accountable for the products they provide to the Government. To hold otherwise would have required nationwide distributors to house their products in warehouses or personally deliver them, thus dramatically increasing the costs of doing business with the Government as well as passing on unnecessary costs to the taxpayers. .
