CHICAGO, Oct. 9, 2014 /PRNewswire/ -- Michael R. Daigle, a partner in the franchise industry's premier full service boutique law firm Cheng Cohen, will share his international expertise at a meeting in Buenos Aires, Argentina later this month. The American Bar Association's (ABA) Section of International Law will hold its fall meeting October 21 – 25 and Daigle is the co-chair of one of the programs to be presented at the conference. Daigle and legal experts from Argentina, Brazil and Colombia will present "The Hidden Traps of Foreign Sales Intermediaries," a 90-minute program that will explore the impact of franchise, agency and other laws relating to the use of sales intermediaries in the distribution of products in Latin America. Topics to be discussed include:
- Which entities the laws are designed to protect - the manufacturer/distributor or the sales agent;
- The risks of unintended employment relationships created by appointing commissioned agents;
- The consequences of the termination or non-renewal of these relationships; and
- The enforceability of key contractual provisions such as protection of intellectual property, non-competition, choice of law and venue.
Daigle represents franchisors of all sizes and in all stages of development, with a specialty in international expansion. He came to Cheng Cohen after years on the corporate side, negotiating and documenting master franchise, area development, licensing and joint venture transactions in more than 50 countries. A frequent speaker at franchise industry events, he has also presented on international franchise matters at ABA conferences in Dublin, Paris, and London. For the past two years, he served as co-chair of the International Commercial Transactions, Franchising and Distribution Committee of the ABA Section of International Law. He is a Franchise Times Legal Eagle and was recently inducted as a Fellow of the ABA, an honor earned by invitation extended to only one-third of one percent of lawyers in each state and up to 300 foreign lawyers.
