Court Reconfirms Sinorgchem's Non-infringement Position in Patent Case

SHANGHAI, July 21 /PRNewswire/ -- Concluding a five-year legal dispute with Flexsys America L.P., the U.S. District Court in Ohio recently entered a final judgment of non-infringement for Jiangsu Sinorgchem and its subsidiaries.

On July 6, 2010, the Ohio Court granted Sinorgchem defendants' motion for summary judgment, finding that they did not infringe the patents-in-suit. The half-decade-long legal affair had been filled with legal wrangling: the case was initially filed in January 2005 and later stayed that year, and was then restarted in mid 2009 in view of a parallel section 337 investigation before the U.S. International Trade Commission (ITC).

Flexsys America initially filed the Complaint in the Ohio district court in January 2005, alleging patent infringement by Sinorgchem. Then, Flexsys America filed a request in the ITC to institute a Section 337 investigation on patent infringement by Sinorgchem in February 2005. The ITC patent infringement investigation was concluded in 2009, with the final finding that Sinorgchem did not in any way infringe the patents-in-suit. As both patent infringement lawsuits have concluded in Sinorgchem's favor, it has been proved again that Jiangsu Sinorgchem is able to freely compete on the U.S. market as well as worldwide market, and provide customers with high-quality products at a competitive price for value.
