EH&S Attorney James T. Dufour to Present Keynote Address at 2016 Sacramento Safety & Health Summit
SACRAMENTO, Calif., Sept. 19, 2016 /PRNewswire-USNewswire/ -- On October 4, 2016, Mr. Dufour will be the keynote speaker at this technical program for environmental, safety and health professionals at the Crowne Plaza Sacramento Northeast, Sacramento, California. He will cover recent developments in Cal/OSHA enforcement and appeals process, including increased penalties, broadening of the definition of repeat violation, and evolution of Heat Illness Prevention—a narrow outdoor work safety measure—to a virtual universal standard, which is the most frequently cited violation generally, as well as serious accident-related.
Dufour's presentation will conclude with a case study of his recent successful appeal of Cal/OSHA citations in the matter of City of Los Angeles Department of Public Works Bureau of Sanitation. This case touches on some of the most vexatious issues facing safety professionals advising California employers, including considering the penalty as only the "tip of the iceberg" given other consequences of an OSHA violation, conflict between current ANSI standards (and other national consensus standards) and those incorporated into Title 8 Safety Orders, and the nuances of Independent Employee Act and Employer Lack of Knowledge affirmative defenses.
The philosophy of Dufour's practice has been the mutually beneficial goal of establishing client safety or Injury and Illness Prevention Programs that not only prevent accidents and injuries, but support the reasonable diligence touchstone necessary to prove these affirmative defenses.
James Dufour has over three decades of experience in representing employers in Cal/OSHA and Fed/OSHA appeals, as well as rulemaking proceedings before the Standards Board, and as a legislative lobbyist for many years.
