Federal Circuit Affirms McKool Smith's $16.8 Million Judgment for Summit 6
DALLAS, Sept. 23, 2015 /PRNewswire/ -- On September 21, 2015, the United States Court of Appeals for the Federal Circuit issued an opinion affirming a $16.8 million patent infringement judgment that McKool Smith secured on behalf of Summit 6 LLC against Samsung Electronics Co. Ltd. and Samsung Telecommunications America, Inc. Ted Stevenson, a principal in McKool Smith's Dallas office, argued the case before the Federal Circuit in September 2014.
McKool Smith's original $15 million verdict was announced on April 5, 2013 following a six-day trial before Judge Reed O'Connor in the U.S. District Court for the Northern District of Texas. The jury found that Samsung infringed Summit 6's patented media uploading technology, U.S. Patent No. 7,765,482, which covers software that automatically processes digital photos before they are transmitted over a network by client devices, such as cell phones. The final judgment ordered an additional $1.8 million in prejudgment interest for a total award of $16.8 million.
"Along with our client, we are very pleased that the Federal Circuit has affirmed the district court's decision," said Ted Stevenson, who served as both lead trial and appellate counsel for Summit 6.
The McKool Smith appellate team included attorneys Ted Stevenson, John Campbell, Joel Thollander, Gretchen Kleinman, Phillip Aurentz, Richard Kamprath, Kat Li, and Ashley Moore, along with Bradley Caldwell of the Caldwell Cassady & Curry firm.
The case is Summit 6 LLC v. Samsung Electronics Co. Ltd., case number 2013-1648, in the U.S. Court of Appeals for the Federal Circuit.
